The tenancy law in Dubai is comprehensive. It is worth noting the below mentioned principles governing tenancy termination, renewal and rent increase as per Dubai tenancy laws:
During the term of the tenancy contract: This is primarily governed by Law 33/2008.
- The tenancy contract cannot be unilaterally terminated during its term. Such termination requires the mutual agreement of the landlord and the tenant.
- The landlord may request the evacuation of the leased premises during the term of the contract only if one of the reasons enumerated under Article 25/1 are fulfilled.
Upon expiry of the tenancy contract.
- Any clause inserted in your tenancy contract relating to its automatic termination upon expiry of its term is void.
- If a tenant remains in occupation of the leased premises upon expiry of the term, and the landlord does not object, then the lease shall be automatically renewed on the same terms and conditions.
- Any modifications to the terms of the tenancy contract for the renewed period are subject to at least 90 days prior notice (unless agreed by the Parties otherwise), including any modification of rent.
- The landlord is in principle entitled to request a rent increase upon expiry of the contract’s term. Such increase (if any) should be compliant with Decree 43/2013. Any disagreement on the new rent should be raised to the Rental Dispute Settlement Center.
- The landlord may request the evacuation of the leased premises upon expiry of the contract’s term only if one of the four reasons enumerated under article 25/2 of law 33/2008 are fulfilled.
